The practices described in this Policy apply to information gathered by us or our subsidiaries and affiliated companies.
Subject to the terms and conditions of this Policy, Butler Machinery and the manufacturers it represents including, but not limited to, Caterpillar Inc., CLAAS KGaA mbH, AGCO Corporation (together the “Manufacturers”) and other third parties including, but not limited to, the Manufacturer’s other dealers, business affiliates and contractors, and other third parties including, but not limited to, other manufacturers or suppliers of Equipment or components thereof (together the “Affiliated Parties”) and components, collect and share data and other information to enhance products and services to support Butler Machinery’s customers. This information is gathered via online and offline means including, but not limited to, applications and platforms for use on or through computers, APIs, mobile devices and other systems. Information is also gathered from telematics or other devices which transmit data from customer machines, products or assets, whether manufactured by the Manufacturers or by other companies. Additional information is gathered through digital offers, through distribution networks, component manufacturers, service providers, and customers and their agents, employees, and representatives.

Butler Machinery collects, receives and shares both Customer Data and Machine Data, as each is defined in this Policy (Customer Data and Machine Data are sometimes referred to, collectively, herein as “Data”).
CUSTOMER DATA.Customer Data is information that can be used to identify, locate or contact you. Butler Machinery collects the following types of Customer Data:
- Contact information that allows us to identify and to communicate with you, such as your name, phone number, username, mailing address and similar information.
- Relationship information that helps us understand who you are and what you want in order to offer you products and services that may interest you, such as your business, location and other demographic information.
- Transaction information about how you interact with us and our business partners, including purchases, inquiries, and customer accounts.
- Information needed to complete your equipment and parts purchases, such as your financial and credit card information.
HOW BUTLER MACHINERY COLLECTS CUSTOMER DATA.
Directly From You. We collect Customer Data directly from you. We will ask you for Customer Data (e.g. contact information and relationship information) when you interact with us, such as when you make a purchase. We may collect additional information from third party data suppliers to help us better understand our customers. We also collect Customer Data when you contact us, such as for customer service purposes.
From Our Business Partners. When you purchase or lease a product or obtain financing, we collect Customer Data (e.g. transaction information and financial account information) from the Manufacturers and financial affiliates. We may also collect Customer Data from third parties (such as when we obtain credit information or need to verify information that you have provided) in order to complete your purchase or assist in securing financing.
HOW BUTLER MACHINERY USES CUSTOMER DATA. Butler Machinery uses Customer Data for a variety of purposes including, but not limited to the following:
Customer Service. To fulfill orders for products or services and for other services related to your order, such as product delivery, maintenance, warranty service, financing, leasing, and credit services.
Product and Customer Support. To provide support, to communicate information regarding monitoring the health of Equipment, to deliver upgrades and product improvement program communications, and to communicate diagnostics and repairs, product safety and recalls.
Marketing. To provide you with communications and offers for products and services from Butler Machinery or our dealers, suppliers and partners, including offers based on your interests, personal and business characteristics and location.
Surveys & Promotional Events. To administer surveys, sweepstakes, contests, loyalty programs and other promotional events.
Communications. To provide you with information that may be of interest, such as Butler Machinery news, manufacturing company magazines, catalogs, announcements, reminders, and technical service bulletins.
Manage Our Everyday Business Needs. To mange things such as payment processing and financial account management, product development, product safety, contract management, website administration, order or contract fulfillment, analytics, fraud prevention, corporate governance, reporting and legal compliance.
MACHINE DATA. Equipment, machines, or work tools (collectively, “Equipment”) purchased, leased, or otherwise rented from Butler Machinery may come equipped with various telematics devices (collectively, “Telematics Systems”) which are capable of transmitting data via cellular, satellite signal, wireless or other systems. This Policy provides you with knowledge of telematics functionality on Equipment.
The information generated by, collected by, or stored in your Equipment or any hardware or device interfacing with your Equipment or otherwise transmitted via Telematics Systems (“Machine Data”) may include but is not limited to the Equipment model number, serial number, performance, and configuration, event recorder data (including location, site and environmental conditions, patterns of use, speed, direction and use of controls), Equipment engine hours, operational data, sensor logs, trends, histograms, fuel consumption and fluid data (including oil, hydraulic and coolant fluid data information and analysis), emissions data, troubleshooting data, Equipment condition, diagnostic data, service meter hours, software and hardware version numbers, and installed attachments as entered into machines and/or hardware devices interfacing with your Equipment. The types of information we collect and share depends on the products or services you purchase, license or access from us or third parties.
We may receive Machine Data directly via Telematics Systems installed on Equipment. We may also receive Machine Data from Manufacturers and Affiliated Parties. This information may be provided to us automatically. You acknowledge and agree that to the extent any Equipment has a Telematics System, any and all Machine Data concerning such Equipment is being transmitted and/or collected by Manufacturers and Affiliated Parties. Some of the reasons for gathering and sharing this data include but are not limited to:
(1) Improving products and services, including without limitation: developing statistical studies, understanding performance issues, and complying with regulations and laws, and (2) serving you by combining Machine Data with other Customer Data to fulfill support agreement requirements, monitor and manage Equipment health and efficiency, respond to inquiries, conduct market research, request feedback and to notify you of promotions.
You agree to allow, and hereby grant, a worldwide, perpetual, fully paid-up, non-exclusive license to Butler Machinery and the Manufacturers and the Affiliated Parties to use, access and transfer the Machine Data in accordance with the terms and conditions of this Policy, including for Machine Data to be transferred to jurisdictions requiring less Machine Data protection as the jurisdiction in which you are located. You further represent and warrant that you have or will obtain all necessary consents from any Machine Data subjects (e.g. Equipment operators, Equipment owners, and all other affected parties) prior to allowing any such subject to use Equipment with a Telematics System.
In the event you transfer ownership of the Equipment, you agree to notify the purchaser (new owner) about the existence of a Telematics System, the Data being transmitted, the purposes for transmitting the Data, and of the existence of this Policy. In addition, you will notify Butler Machinery you have transferred ownership of the Equipment. You acknowledge and agree that provision of Machine Data is voluntary. Should you elect to discontinue sharing of Machine Data via the Telematics System, you should contact Butler Machinery in accordance with this Policy for instructions on disabling the Telematics System and to arrange for cancellation of any data subscriptions.
Butler Machinery recommends you monitor Machine Data from Equipment to ensure machine health and longevity. Butler Machinery assumes no liability for machine health or loss of production unless otherwise specified by contract. Recommendations made by Butler Machinery to you regarding machine health may not incorporate all necessary information or details. You assume the responsibility and cost associated with all Equipment diagnostics and repairs. Butler Machinery reserves the right, but is not obligated to, monitor Machine Data from your Equipment. While Butler Machinery may notify you of Equipment issues based on Machine Data, Butler Machinery is under no obligation to do so. All of your actions or inaction in response to recommendations provided by Butler Machinery remain your responsibility.
By purchasing, leasing, or otherwise renting Equipment equipped with a Telematics System, or by using Butler Machinery’s, a Manufacturer’s, or an Affiliated Party’s web, mobile or other applications, you agree to and accept that Machine Data and other information you supply may be accessible by Butler Machinery, the Manufacturers or the Affiliated Parties as is detailed in this Policy. You acknowledge and agree that you are responsible to periodically review this Data and Privacy Policy and the links contained herein for any updates.
SHARING AND USE OF DATA.
Subject to and in accordance with the terms and conditions of this Policy, we may share your Data with our affiliates, suppliers, vendors, and/or their agents and employees as we deem necessary for the provision of goods and services to you. Specifically, we may share your Data: (i) with the manufacturer of your equipment; (ii) with third parties assisting us in the provision, administration, and management of goods and services generally; (iii) with third parties that assist us in providing goods and services that you request; (iv) with third parties that support our business operations or provide marketing or advertising services on our behalf, including marketing, technical, accounting, legal or other professionals; and (v) as otherwise permitted by law or approved by you. We may use your Data for our general business operations if it is in a form that is not capable of being personally identified with you or if it is combined with Data from one or more other customers in aggregate form that does not personally identify any particular customer.
CONFIDENTIALITY, SECURITY AND STORAGE OF DATA.
Except as otherwise provided in this Policy, we will keep all of your Data containing personally identifiable information, including but not limited to: name; address; telephone number; email address; identification number; usernames and user IDs; employer names; employee titles or roles; user profile information; geo-location information; information about any computer or mobile device; audio-visual data (collectively, “Personal Information”) with which you access as private and will not share it with third parties, unless such disclosure is necessary to:
